Abstract
"The Administration of Justice", based on the forty-fifth series of Hamlyn Lectures, Lord Mackay of Clashfern, the Lord Chancellor, examines four aspects associated with the administration of justice in the United Kingdom, namely: the judges; the courts; legal services; alternative dispute resolution. In the first three chapters Lord Mackay draws on his experience as an Advocate, a Judge, a Law Lord and as Lord Chancellor to provide an overview and assessment of a number of the major issues facing those who work in the law. In the concluding chapter he examines a particular area of policy - Alternative Dispute Resolution - and considers whether its development might enhance the existing civil justice system. Key policy issues affecting judges, the courts and the provision of legal services are also assessed with a discussion of the differing views and approaches. Lord Mckay sets out his views on several controversial topics, including the independence of the judiciary. He argues firmly against a Judicial Appointments Commission. He calls for the simplification of the rules in civil procedure. He also sets out the advantages to our constitution of the office of Lord Chancellor, straddling as it does the executive and the judiciary." -Voila
