Here we have Justice Holmes the oracle of the Supreme Court; and Justice Holmes the cigar-smoking, burlesque-loving, fire-chasing conversation-making human being.
These pages will reveal the subtle influence of Holmes on today's court. The phrase "deliberate speed" and the word "penumbra" were formulas first with Justice Holmes. His influence is both pervasive and persuasive. A careful reading of current Supreme Court opinions and the material here presented will show that Justice Holmes still sits.
The nuggets of Holmes's wisdom, humor and erudition selected by Mr. Bander and presented in the Opinions Section of this book have been arranged so that they can be read without intervening bits of scholarship and citations. The table of cases gives the citations of the opinions from which these excerpts were taken (by a bracketed numbering system) and also presents, in chronological order, every case in which justice Holmes wrote the opinion or concurred specifically in an opinion, or dissented from an opinion.
